October to remember for Keoghs Fraud Rings with eleven trial wins

03/11/2016

The Keoghs Fraud Rings team are used to winning big at trial, but in the month of October even they were amazed as the successes continued to rack up.

The prolific period began with a four day trial and led to a finding of fundamental dishonesty with the claimant being ordered to pay costs. Amazingly, at one point the claimant even agreed with counsel when it was suggested that the accident didn’t happen!

At another eventful trial, the claimant was reduced to tears on the witness stand as they were found to be fundamentally dishonest, with costs assessed in the sum of £32,500.

Whilst some cases led to findings of fraud, others were struck out on different grounds.

In one example, an initial trial in August was adjourned on the basis that the claimant attended without an interpreter. With the claimant’s solicitor failing to resolve the issue by the second trial date, along with the fact that the claimant had signed statements without a full command of English, the claim was struck out for abuse of process. The judge stated that this conduct had specifically prevented a trial where the issue of fraud was raised.

Sometimes claimants can see the writing on the wall before a trial has even started and, in one such case last month, the claimants failed to attend trial despite being reminded by their solicitor. Needless to say, all three claims were struck out.

To top off the month, the team also recorded one of its fastest ever results with a judgment delivered by 1pm on the first day! Suffice to say, the judge deemed the claimant’s evidence to be poor and found that he had failed to prove his claim, which was swiftly dismissed.

All in all, Keoghs Fraud Rings managed to save £959,654.00 for clients throughout the month of October.

And the successes don’t appear to be slowing, as the team kicked off November with another trial win and another finding of fundamental dishonesty. In this case the judge at the two day trial found the claimant to have dishonestly continued with heads of loss for hire and storage, when he conceded under cross examination that he actually needed neither. Altogether this led to savings of over £26,000 for damages and £32,000 for costs!

Head of Fraud Rings, Ruth Needham, was delighted with the string of results, saying:

“When dealing with any Fraud Ring operation, our experts work incredibly hard to ensure that all bases are covered in order to bring these organised criminals to justice. To win so many trials in one calendar month is a huge testament to the dedication of everybody in the team and they can be very proud of these results”.
