Welcome to the second issue of Fraud AWARE. It has been another busy quarter in the fraud arena with the closing of two consultations and the long awaited MOJ response to another.

Partner and director of complex fraud, Elaine Ibbotson coordinated Keoghs’ response to both the Sentencing Council consultation into fraud sentencing and the Law Commission’s request for information regarding fraud by victims of personal injury – this edition contains the summary of her submissions.

A key outcome of the MOJ’s response to the whiplash consultation that merits further consideration is that of the proposals to better manage medical experts. This is a particular area of focus within Keogh’s counter-fraud services division, with Simon Winnard, director of healthcare fraud, leading a review of the main medical experts used across claims received into Keoghs. Simon’s findings prompt some immediate concerns – see page 18 for details.

Also in this issue of Fraud AWARE, Pam Davies and Mark Beales share their success on a claim worth over £100,000 that was defeated after adopting strong credit hire fraud arguments and Ruth Needham highlights the need for judges to clarify the rationale for some of their decisions following the case of Hussain v Hussain & Aviva.
