Introducing key members of the Commercial Litigation Editorial Team

The authors of the articles within this edition of AWARE are members of the commercial litigation team, which is led by partner Matthew Rogers. The 28 strong team has extensive experience in commercial insurance disputes and property damage claims.

We are proud of our team of specialist commercial lawyers, some of whom are dual qualified and / or are very experienced in business. Claims are often highly technical and require a deep understanding of insurance law, coupled with high level commercial acumen.

Our experienced team has a proven track record and provides a practical, hands on approach. They excel in resolving all types of commercial insurance disputes either through robust court litigation or through alternative dispute resolution methods such as negotiation, arbitration or mediation - to resolve matters at the earliest opportunity.

We understand how our clients operate and we know about business, priding ourselves on combining high quality expertise with a value for money business support service - to ensure cost reductions and the best outcome for clients.

The team resolves individual high value complex disputes as well as low value claims and volume work.

Our team are mindful of the potential for recovery of insurers outlay and we have an enviable reputation for pursuing subrogated recoveries, utilising Keoghs’ Recovery Assist product.

We work closely with insurers, insureds, loss adjusters and brokers, calling upon specialist experts from counsel, forensic scientists, accountants and underwriters whenever necessary, to ensure we achieve the best results for our clients.

The team advise on policy indemnity coverage and first party fraud issues. We also deal with both defended and subrogated recovery actions relating to commercial and household property damage claims arising out of construction and engineering projects, vehicle impact, fires, escapes of water, environmental factors such as oil escapes and subsidence, theft, malicious damage, landlord and tenant issues and defective products.

After creating and developing a number of businesses in the retail, transport and property sectors, Anthony joined Keoghs as a solicitor in 2008 and heads up a liability team within the commercial litigation department, dealing with employers and public liability claims.

Anthony regularly deals with large loss property damage claims including boundary disputes, Party Wall Act and trespass related issues.

Anthony’s extensive commercial and legal experience and pragmatic approach to claims resolution has resulted in numerous significant costs savings for insurer clients and the maintenance of commercially sensitive relationships between litigants.

Jody joined the commercial litigation team in 2011 before qualifying as a solicitor in 2012. Since qualification, Jody has achieved significant successes with many small, fast and multi-track claims in respect of property damage, including escapes of water, fire damage, subsidence, defective products, damage to underground utilities and damage to vehicles.

Jody also deals with subrogated recovery claims on behalf of insurers and specialises in dealing with Part 8 claims. In addition, Jody regularly advises clients in respect of liability, policy indemnity and coverage issues.

Lucy joined Keoghs in July 2013 and has been assisting members of Anthony Middleton’s team deal with a wide range of litigated matters ever since.

Stuart Hunt

Stuart has worked at Keoghs since 2008, qualifying as a solicitor in the commercial litigation team in October 2012.

He is responsible for a varied caseload, with particular emphasis on policy indemnity disputes in both household and commercial insurance claims, including policy voidance matters. Stuart handles a variety of product and public liability claims, and also provides assistance on large value matters.

He also deals with a caseload of fast and multi-track recovery claims for several insurers, in particular subrogated recoveries resulting from vehicle impact damage claims.

Liam has worked with the commercial litigation team since 2009. He qualified as a solicitor in March 2013. Liam is responsible for a wide ranging and varied number of work types arising out of both household and commercial insurance claims.

This work includes advising insurers on product and public liability claims as well as policy indemnity and contractual disputes. Liam is also experienced in recovery matters, regularly acting on behalf of insurers to recover their outlay.

Jill joined the commercial litigation team in 2010 and subsequently qualified as a solicitor in 2015. Jill currently assists Anthony Mangham and Warren Heyman on defendant liability claims as well as recovery files.

Jill’s varied caseload includes both commercial and residential disputes covering fire and escape of water disputes as well as product liability and subsidence claims.
