The case of the spitting burger

In this case, the claimant alleged that whilst he was waiting in line for food on the defendant’s premises, he was struck by ‘spitting fat’ from a flipped burger which was being prepared by one of the defendant’s employees.

As a result, he claimed to have suffered a burn injury to his neck. Interestingly, when we were presented with photographs of the injury this looked very similar to a shaving rash.

Liability was robustly denied throughout and once litigated our Keoghs team undertook a site visit to investigate.

It was clear when speaking to the first aider that the claimant had waited several hours before reporting the alleged accident, not what you would expect from someone suffering with a burn injury.

Furthermore, the defendant was able to demonstrate clear training procedures and safe systems of working.

Following the exchange of witness evidence the claimant quickly discontinued against our client.

This case resulted in an overall saving of £10,900 for the client, who was ‘flipping’ made up!
