Paul Baxter
Biography
Paul has handled a variety of liability cases and specialises in motor claims involving large loss, catastrophic injury and fatalities.
Paul worked for two large insurers from 1995 before commencing his legal career in the claimant arena in 2003. He later joined a large national defendant firm, where he spent 10 years before joining Keoghs in 2016.
Notable cases include:
- Exploring the limit of vicarious liability in an RTA in which one passenger was killed and another seriously injured when their colleague fell asleep at the wheel after the sixth consecutive 13 hour shift. A significant financial contribution was obtained from the defendant's employer.
- In a reported case in 2015 Paul obtained a 2/3 contribution at trial from the claimant motorcyclist for his excessive speed on approach to the brow of a hill where he collided with a tractor resulting in significant injuries.
- Successfully defeated a claimant's application to disapply the Limitation Act following a road traffic accident in 1992, where the van in which she was travelling was struck by a train on a level crossing, fatally injuring a number of occupants and causing the claimant to suffer serious injury.
