    Welcome to the third issue of Credit Hire AWARE. For this quarter we have tried to provide some clarity on specific technical issues, with updates on Keoghs’ Court of Appeal (CoA) successes, the impact on the market in respect of need arguments, and further insight into credit repair labour rate disputes.

    As always our counterparts in credit hire fraud have contributed to the review; this quarter we have included the experiences of some of our fee earners in that area to highlight the work, and successes, they have seen in the period.

    A late addition to the publication was Steve Thomas’ (Director of Market Affairs) overview of the Government’s Consultation Paper on whiplash claims; something I thoroughly recommend as worth a read. Although this is outside the boundaries of credit hire specifically, the ramifications will no doubt impact on the market. Be it the decision not to increase the small claims limit for the time being, or the potential impact of ABS structures with their own medical agency, it will be of great interest to see the fall out as the sector evolves.
