The Lowdown on Lockdown Farmed Claims

In July’s blog, I identified differing types of late notified claims which have plagued insurers following COVID-19. However, insurers are now facing a fresh challenge in ‘the new normal’ from a specific type of whiplash claim arising out of minor road traffic accidents. These Coronaclaims or Lockdown Farmed Claims (LFCs) are submitted into the MOJ Portal and quickly followed with a medical report prepared remotely, taking advantage of MedCo temporarily lifting the ban on such examinations. They often arise out of innocuous accidents in car parks at low speed in which injury is unlikely.

A recent claim involving a chain of medical inaccuracies and alleged physiotherapy has been successfully defended by Keoghs and Mulsanne Insurance, with a finding of fundamental dishonesty. The case highlights counter-fraud processes for defending claims layering which have resulted in a nomination for Collaboration of the Year at October’s Insurance Fraud Awards.

Recording Medical Examinations

We recently published an impact assessment following the decision by MedCo to temporarily lift the ban on remote video examinations. The recording of such video examinations is optional but we suggested that compensators should put the claimant on notice that they expect the examination to be recorded and they may seek sight of that recording. Here we look at the reasons for this and the admissibility of such recordings.
