The forthcoming amendments to CPR Practice Direction 16 taking effect from the 6th April 2020 will be of particular interest to those involved in credit hire litigation; for the first time introducing mandatory requirements to plead within a Statement of Case certain matters specifically in relation to any credit hire claim. There are also new provisions in relation to statements of truth and witness statements.

Keoghs acted for Aviva in the case of Harries v Baguley, where the claimant issued proceedings for the resolution of liability after hiring a car for almost 1,000 days (at the point of the hearing) estimated to be worth in the region of £400,000.

In the recent judgment of Jamie Davis v Skyfire Insurance Company Limited, Keoghs Scotland LLP were successful representing the respondent, Skyfire, in a costs hearing arising from a credit hire claim.
In a refreshing decision in the County Court at Croydon, District Judge Gambril ordered the claimant to pay the defendant’s costs in the sum of £800 due to the claimant’s unreasonable behaviour.
